Section 88 of the Localism Act 2011 provides that any qualifying use of the land or building must not be an ancillary use. The evidence that I have considered in respect of this application indicates that, to the extent that the historic use described in the application might otherwise be a qualifying community use, the use of the theatre has in fact at all times been ancillary to the primary use of Stanford Hall. It also appears likely that any future such use would remain ancillary. I have also noted that the application for nomination, in section A5 states that the use of Stanford Hall Theatre by performing societies and clubs ceased in 2004/05.I do not consider that a period of over 9 years represents “the recent past“, for the purposes of section 88(2)(a) in the context of this application. Whilst the phrase is not defined in the Act, it is clear from the Community Right to Bid: Non-statutory Advice Note for Local Authorities (issued by the DCLG in October 2012) that the main thrust of the statutory provisions in the Localism Act 2011 is to protect amenities that are threatened with sale or closure. That protection is extended to situations where there has been a recent closure. I do not consider the community use described to be in the recent past having regard to all of the circumstances and, consequently, the application fails for that reason too.
